Rowe’s Construction plead guilty to a charge under the Northwest Territories General Safety Regulations

Yellowknife, NT (April 14, 2015) – On April 1, representatives of 851791 N.W.T. LTD., operating as Rowe’s Construction, appeared in the Territorial Court of the Northwest Territories in Yellowknife and plead guilty to Section 9 of the General Safety Regulations.  As an employer, Rowe’s failed to ensure the adequate instruction of each worker in the safe performance of their duties.

This charge stemmed from an incident in February 2013, where a worker was seriously injured in the operation of an ice auger during construction of an ice road near Trout Lake, NT. The sub-contracted worker did not receive any training with respect to the safe use and operation of the machine, nor did he receive any specific safety procedures to follow when working in close proximity to an ice auger.

All other charges in the matter were withdrawn.

Rowe’s Construction was sentenced to a fine of $40,000, plus a 15% Victim of Crime Surcharge and given six months to pay the fine.

It is important that all employers and supervisors recognize that their safety responsibilities, including supervision and instruction, extend to any and all individuals working under them, including sub-contractors.
